ACCIDENT BENEFITS AND TORT CLAIMS

Two Claims May Arise From an Ontario Car Accident

Depending on the circumstances, an injured person may have an accident benefits claim, a claim against an at-fault party, or both. These claims involve different insurers, legal rules and forms of compensation.

Accident Benefits Claim

Statutory accident benefits may be available regardless of who caused the collision. As of July 1, 2026, medical, rehabilitation and attendant-care benefits remain mandatory. Other accident benefits are optional, and the coverage available will depend on the applicable insurance policy and the person making the claim.

Tort Claim Against an At-Fault Party

If another person caused or contributed to the collision, you may also be able to pursue a liability claim against the responsible parties. This claim may seek compensation for pain and suffering, income loss, healthcare expenses and other proven losses, subject to Ontario’s statutory rules.

These claims are separate but interconnected. Each has its own evidence, procedures and deadlines, so they should be considered together from the beginning.

There is no standard formula for valuing a car accident claim. The benefits and damages that may be available depend on the applicable insurance coverage, how the collision occurred, the nature of the injuries, the resulting losses and the supporting evidence.

Not every category applies to every claim. The applicable policy, evidence and statutory restrictions must be reviewed before the potential value of a case can be properly assessed.

Treatment and Care

Medical, rehabilitation, attendant-care and future treatment expenses may be available through applicable insurance benefits or a liability claim.

Income-Related Losses

Benefits or damages may address time missed from work, lost income and a reduced ability to earn income in the future.

Pain and Loss of Enjoyment

A liability claim may include damages for pain, suffering and the effect of the injuries on everyday life, subject to Ontario’s statutory requirements.

Out-of-Pocket Expenses

What Should You Do After a Car Accident in Ontario?

Your health and safety come first. The steps taken immediately after a collision can also affect the available evidence, your insurance claim and your legal rights.

Get to Safety and Call for Help

Move out of active traffic if it is safe to do so. Call 911 if anyone is injured, there is an immediate danger or emergency assistance is required.

Report the Collision When Required

Report the collision to police when required, including when someone is injured or the apparent damage to vehicles or other property exceeds $5,000. Follow police instructions about attending a Collision Reporting Centre.

Exchange and Preserve Information

Obtain the other drivers’ names, licence information, licence-plate numbers and insurance details. Photograph the vehicles, road conditions and surrounding area, and collect contact information from witnesses.

Seek Medical Attention

Obtain an appropriate medical assessment, particularly if you are experiencing pain or other symptoms. Explain all your symptoms and follow the treatment recommendations you receive.

Notify Your Insurance Company

Report the collision to your insurer within seven days, or as soon as possible afterward if you are unable to meet that deadline. If you were injured, ask for the forms required to apply for accident benefits.

Preserve Your Records and Obtain Advice

Keep medical records, receipts, employment information and correspondence relating to the collision. Consider obtaining legal advice before signing a release or accepting a final settlement.
