HELP AFTER A COMMERCIAL VEHICLE COLLISION
How an Ontario Truck Accident Lawyer Can Help
A collision involving a truck or commercial vehicle can raise questions about the driver, vehicle owner, employer, and multiple insurers. We investigate these relationships, identify potential claims, and manage the legal process while you focus on your recovery.
01
Identify Responsible Parties
We investigate who owned, operated, and maintained the vehicle to determine which individuals or businesses may be legally responsible for your injuries.
02
Preserve Important Evidence
We take steps to preserve relevant evidence, which may include dashcam footage, driver logs, inspection reports, maintenance records, and dispatch communications.
03
Navigate Insurance Claims
We explain the accident benefits and liability claims that may be available, review relevant coverage, and handle communications with the insurers involved.
04
Document Your Injuries and Losses
We gather medical, employment, and other supporting evidence to show how the collision has affected your health, ability to work, and daily life.
05
Pursue Compensation
We assess your losses, protect applicable deadlines, and pursue compensation through negotiation or litigation, based on the circumstances of your claim.
ACCIDENT BENEFITS AND TORT CLAIMS
Two Claims May Arise From an Ontario Truck Accident
Depending on the circumstances, an injured person may have an accident benefits claim, a claim against an at-fault party, or both. These claims involve different insurers, legal rules and forms of compensation.
01
Accident Benefits Claim
Statutory accident benefits may be available regardless of who caused the collision. As of July 1, 2026, medical, rehabilitation and attendant-care benefits remain mandatory. Other accident benefits are optional, and the coverage available will depend on the applicable insurance policy and the person making the claim.
02
Tort Claim Against an At-Fault Party
If another party caused or contributed to the collision, you may also be able to pursue a claim against those legally responsible. Depending on the circumstances, this may include the driver, vehicle owner, trucking company, or another business. Compensation may cover pain and suffering, income loss, care costs, and other proven losses, subject to Ontario’s statutory rules.
These claims are separate but interconnected. Each has its own evidence, procedures and deadlines, so they should be considered together from the beginning.
TYPES OF COMMERCIAL VEHICLE ACCIDENTS
Truck and Commercial Vehicle Accident Claims We Handle
We represent people injured in collisions involving transport trucks, delivery vehicles, and other vehicles used for business. Each claim requires attention to how the collision happened, the businesses involved, and the impact of the injuries.
01
Transport Trucks and Tractor-Trailers
Collisions involving large trucks can raise questions about stopping distance, lane changes, driver fatigue, and vehicle condition. We investigate the circumstances and identify relevant evidence.
03
Delivery Vans and Courier Vehicles
Delivery vehicle collisions can occur on highways, residential streets, and in parking areas. We examine the driver’s actions and the ownership and business arrangements behind the delivery.
02
Dump Trucks and Construction Vehicles
Claims involving dump trucks, concrete mixers, and other construction vehicles may involve turning movements, reversing, site access, visibility, or unsecured loads.
04
Company Cars and Service Vehicles
Collisions involving company cars, work pickups, and service vans require a careful review of who owned the vehicle, who employed the driver, and the purpose of the trip.
05
Buses and Commercial Passenger Vehicles
We assist people injured in collisions involving buses, shuttles, and other commercial passenger vehicles, whether they were passengers, occupants of another vehicle, pedestrians, or cyclists.
POTENTIAL COMPENSATION
Compensation After an Ontario Truck Accident
The value of a truck or commercial vehicle accident claim depends on the injuries, their impact on your life, who is legally responsible, and the available insurance coverage. We assess both your immediate losses and your future needs, supported by medical, employment, and other evidence.
Not every category applies to every claim. The applicable policy, evidence and statutory restrictions must be reviewed before the potential value of a case can be properly assessed.
Treatment and Care
Medical, rehabilitation, attendant-care and future treatment expenses may be available through applicable insurance benefits or a liability claim.
Income-Related Losses
Benefits or damages may address time missed from work, lost income and a reduced ability to earn income in the future.
Pain and Loss of Enjoyment
A liability claim may include damages for pain, suffering and the effect of the injuries on everyday life, subject to Ontario’s statutory requirements.
Out-of-Pocket Expenses
Reasonable accident-related expenses may include medication, transportation, assistive devices and other necessary costs.
Housekeeping and Caregiving Support
Certain insurance coverages or claims may address the cost of assistance with responsibilities the injured person can no longer perform.
Future Care and Long-Term Losses
More serious injuries may create continuing treatment, support and income needs that require careful long-term assessment.

Get to Safety and Call for Help
Move out of active traffic if it is safe to do so. Call 911 if anyone is injured, there is an immediate danger or emergency assistance is required.
Report the Collision When Required
Report the collision to police when required, including when someone is injured or the apparent damage to vehicles or other property exceeds $5,000. Follow police instructions about attending a Collision Reporting Centre.
Identify the Driver and Commercial Vehicle
If safe, collect the driver’s licence and insurance details, the company name, and the licence plates of both the truck and trailer. Photograph vehicle markings, damage, and the surrounding scene. Obtain witness contact information and preserve any dashcam footage.
Seek Medical Attention
Obtain an appropriate medical assessment, particularly if you are experiencing pain or other symptoms. Explain all your symptoms and follow the treatment recommendations you receive.
Notify Your Insurance Company
Report the collision to your insurer within seven days, or as soon as possible afterward if you are unable to meet that deadline. If you were injured, ask for the forms required to apply for accident benefits.
Preserve Your Records and Obtain Advice
Keep medical records, receipts, employment information and correspondence relating to the collision. Consider obtaining legal advice before signing a release or accepting a final settlement.
UNDERSTANDING LIABILITY
